Agreement to Our Legal Terms

We are ParcelGoose ("Company," "we," "us," "our"). We operate parcelgoose.com, as well as any other related products and services that refer or link to these legal terms (the "Legal Terms") (collectively, the "Services"). ParcelGoose provides a package forwarding service that assigns US-based shipping addresses to customers and forwards packages to international destinations, including Saudi Arabia. We do not sell, manufacture, or take ownership of any goods we forward on your behalf.

These Legal Terms constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you"), and ParcelGoose, concerning your access to and use of the Services. You agree that by accessing the Services, you have read, understood, and agreed to be bound by all of these Legal Terms. IF YOU DO NOT AGREE WITH ALL OF THESE LEGAL TERMS, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SERVICES AND YOU MUST DISCONTINUE USE IMMEDIATELY.

We reserve the right, in our sole discretion, to make changes or modifications to these Legal Terms at any time and for any reason. We will alert you about any changes by updating the "Last updated" date of these Legal Terms. You will be deemed to have accepted the changes in any revised Legal Terms by your continued use of the Services after the date such revised Legal Terms are posted.

1. Our Services

The information provided when using the Services is not intended for distribution to or use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation. Those who choose to access the Services from other locations do so on their own initiative and are solely responsible for compliance with local laws, to the extent local laws are applicable.

2. Eligibility and User Representations

You must be at least 18 years old to use our Services. By using the Services, you represent and warrant that: (1) you have the legal capacity and agree to comply with these Legal Terms; (2) you are not a minor in the jurisdiction in which you reside; (3) you will not access the Services through automated or non-human means, whether through a bot, script, or otherwise; (4) you will not use the Services for any illegal or unauthorized purpose; and (5) your use of the Services will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any current or future use of the Services.

We are the owner or licensee of all intellectual property rights in our Services, including all source code, databases, functionality, software, website designs, text, and graphics in the Services (the "Content"), as well as the trademarks, service marks, and logos contained therein (the "Marks"). Our Content and Marks are provided "AS IS" for your personal, non-commercial use only. Except as expressly permitted, no part of the Services and no Content or Marks may be copied, reproduced, republished, uploaded, posted, distributed, sold, or otherwise exploited for any commercial purpose without our express prior written permission. If you wish to make any other use of the Services, Content, or Marks, please address your request to legal@parcelgoose.com.

5. Prohibited Items

You are responsible for ensuring your shipment complies with all applicable US export laws and the import regulations of your destination country. A full list of items prohibited or restricted by US Customs and Border Protection can be found at cbp.gov. You are additionally responsible for verifying any restrictions imposed by your destination country.

Regardless of applicable law, ParcelGoose will not knowingly forward the following:

Shipping prohibited items may result in immediate account termination, forfeiture of packages, and reporting to relevant authorities. We reserve the right to inspect, refuse, or return any package at our discretion.

You may not access or use the Services for any purpose other than that for which we make them available. As a user of the Services, you agree not to:

We reserve the right, but not the obligation, to: (1) monitor the Services for violations of these Legal Terms; (2) take appropriate legal action against anyone who violates the law or these Legal Terms; (3) refuse, restrict, or disable access to any content at our discretion; and (4) otherwise manage the Services to protect our rights and property and facilitate their proper functioning.

8. Customs and Import Compliance

You are solely responsible for ensuring your shipments comply with the customs regulations of your destination country. You agree to provide accurate customs declarations, including truthful descriptions and declared values. Under-declaring customs value is illegal and may result in package seizure. ParcelGoose is not responsible for packages seized or rejected by customs. No refund will be issued for packages refused at the destination country's border.

9. Storage

Packages are stored at our Houston, TX warehouse facility free of charge for the first 14 days after arrival. After 14 days, a storage fee of $2.00 per package per day applies until the package is shipped or retrieved.

Packages unclaimed after 90 days may be donated, disposed of, or returned to the sender. We are not liable for packages abandoned beyond this period.

10. Shipping Rates, Fees, and Insurance

Shipping rates are calculated based on package dimensions, weight, and destination. All quoted rates are in US dollars. Additional fees may apply for special services such as repackaging, consolidation, photography, or insurance. Where insurance is added, the fee reflects the carrier's own cost of providing that coverage. Payment is required before packages are dispatched. We use Stripe for secure payment processing; ParcelGoose does not store your card details.

11. Term and Termination

These Legal Terms remain in full force while you use the Services. We reserve the right to deny access to and use of the Services, without notice or liability, to any person for any reason, including breach of these Legal Terms. If we terminate or suspend your account, you are prohibited from registering a new account under your name or any other name, even on behalf of a third party.

12. Modifications and Interruptions

We reserve the right to change, modify, or remove the contents of the Services at any time without notice, and we cannot guarantee the Services will be available at all times. We will not be liable to you for any modification, suspension, or discontinuance of the Services.

13. Governing Law

These Legal Terms shall be governed by and defined following the laws of the State of Texas, United States. ParcelGoose and yourself irrevocably consent that the courts of Texas shall have exclusive jurisdiction to resolve any dispute which may arise in connection with these Legal Terms.

14. Dispute Resolution

Informal Negotiations. To expedite resolution and control the cost of any dispute related to these Legal Terms, the parties agree to first attempt to negotiate any dispute informally for at least 30 days before initiating arbitration.

Binding Arbitration. If the parties are unable to resolve the dispute through informal negotiation, the dispute shall be finally resolved by binding arbitration. The number of arbitrators shall be one. The seat of arbitration shall be Houston, Texas, United States. The language of the proceedings shall be English, and the governing law shall be the substantive law of the State of Texas, United States.

Restrictions. Any arbitration shall be limited to the dispute between the parties individually; no arbitration shall be joined with any other proceeding, and there is no right to arbitrate any dispute on a class-action basis.

Exceptions. Disputes seeking to enforce or protect intellectual property rights, disputes arising from allegations of theft, piracy, or unauthorized use, and claims for injunctive relief are not subject to the informal negotiation and arbitration provisions above.

15. Corrections

There may be information on the Services that contains typographical errors, inaccuracies, or omissions, including pricing and availability. We reserve the right to correct any such errors and to update information on the Services at any time, without prior notice.

16. Disclaimer

THE SERVICES ARE PROVIDED ON AN AS-IS AND AS-AVAILABLE BASIS. YOU AGREE THAT YOUR USE OF THE SERVICES WILL BE AT YOUR SOLE RISK. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT AND WILL NOT BE LIABLE FOR ANY ERRORS, INTERRUPTIONS, OR UNAUTHORIZED ACCESS TO OUR SERVERS.

17. Limitations of Liability

ParcelGoose acts as a forwarding agent only. We are not responsible for packages lost or damaged in transit by a carrier — all such claims must be filed with the carrier directly. If a package is damaged during handling at our warehouse facility, we will compensate you for the fair market value of the damaged items, up to a maximum of $100 per shipment. Damage claims must be reported within 7 days of the incident.

We are not liable for packages lost or delayed by carriers, customs delays or seizures, packages refused by the destination country, or losses due to inaccurate address or customs information provided by you.

IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, OR SPECIAL DAMAGES ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER WILL AT ALL TIMES BE LIMITED TO THE LESSER OF THE AMOUNT PAID BY YOU TO US OR US$100. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

18. Indemnification

You agree to defend, indemnify, and hold us harmless, including our officers, agents, partners, and employees, from any loss, damage, liability, or claim, including reasonable attorneys' fees, made by any third party due to or arising out of: (1) your use of the Services; (2) breach of these Legal Terms; (3) any breach of your representations and warranties in these Legal Terms; or (4) your violation of the rights of a third party.

19. User Data

We will maintain certain data that you transmit to the Services for the purpose of managing performance, as well as data relating to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.

20. Electronic Communications, Transactions, and Signatures

Visiting the Services, sending us emails, and completing online forms constitute electronic communications. You consent to receive electronic communications, and you agree that all agreements, notices, disclosures, and other communications we provide to you electronically satisfy any legal requirement that such communication be in writing. You agree to the use of electronic signatures, contracts, orders, and other records, and to electronic delivery of notices and records of transactions initiated or completed via the Services — including payments processed through Stripe.

22. Miscellaneous

These Legal Terms and any policies posted by us on the Services constitute the entire agreement between you and us. Our failure to enforce any right or provision shall not operate as a waiver of that right or provision. If any provision is determined to be unlawful or unenforceable, that provision is deemed severable and does not affect the validity of the remaining provisions. There is no joint venture, partnership, employment, or agency relationship created between you and us as a result of these Legal Terms or use of the Services.

23. Changes to These Terms

We may update these Legal Terms from time to time. We will notify you of material changes via email or a notice on our website. Continued use of the Services after changes constitutes acceptance.
